There is a theoretical controversy in the books of Usul al-Fiqh, in the past and the present, about whether the ruling should be attached to its reason (al-Hikmah), or its apparent and stable cause (al-Illah). Looking at the practical cases of the jurists, we found them sometimes attaching rulings to its reason, and sometimes to its cause, so there is a need to know the factors that affect their choices. By extrapolation, the researcher reached at nine factors that affect referring the ruling to its cause or to its reason in jurisprudential cases.

The proposed method based on detecting the decrease in ultimate bearing capacity of the pile shaft (excluding the share of pile tip) after sliding downward. This was done via conducting an experimental study on three installed R.C piles in a sandy clayey silt soil. Heat transfer performance of two horizontal parallel plates subjected to discrete heating from the upper plate is studied and analyzed under the condition of different gap size between the heating elements with water as the working fluid. The investigation includes the variation of Reynolds number and the heat flux along with the position of the heating elements to discover the effect of different boundary conditions on the gap size variation.
